Valerie represents clients in regulatory and litigation matters, including cleanup of contaminated property, disputes over cleanup liability and cost allocation, insurance recovery for environmental liabilities, environmental permitting, land use, and tort claims arising from environmental conditions. Previously an Assistant Attorney General representing the State of Washington Department of Ecology, Valerie has broad experience in federal and state hazardous waste cleanup laws, water quality and water resources issues, and waste management.
Advise buyers, sellers, lessors/lessees, and licensees of contaminated or potentially-contaminated property about environmental liabilities and risk management in real estate and corporate transactions.
Represent clients in negotiations with regulatory agencies over cleanup obligations.
Represent potentially responsible parties at federal and state hazardous waste sites. Representation includes negotiation of cleanups, cost allocation, and natural resource
Work with clients to identify and pursue insurance coverage for cleanup under historical liability policies and advise clients on procurement of new environmental risk insurance.
Represent clients in pre-litigation and litigation matters, including defense of enforcement actions and negotiation of enforcement orders, tort claims arising from environmental conditions, and disputes over liability for environmental cleanup costs.
Counsel clients on compliance with laws regulating manufactured products, including pesticides and electronic products.
Advise clients on compliance with Clean Water Act permitting requirements, including permittees operating under Washington’s Industrial Stormwater General Permit and
Construction Stormwater General Permit.
Represent and advise clients in land use matters, including obligations arising under the State Environmental Policy Act.
